Murder suspects set for trial

TIFTON — Jamie Underwood and Thomas Mathis, co-defendants in the Hispanic murders of 2005, head the list of 47 cases called for criminal trials beginning March 19.

The criminal court calendar for the Superior Court of Tift County was released this week by Gary McCorvey, Chief Judge of Tift Superior Court, who said his court would not allow any negotiated pleas during trial week.

The upcoming trials for Underwood and Mathis are not for the murders of six Hispanic men, but for crimes they are alleged to have committed just prior to the Sept. 30, 2005, killing rampage.

In case 2005CR311, Underwood, Mathis and Nathan Anthony Allen are being tried for two counts of armed robbery, burglary, aggravated assault and possession of a firearm during the commission of a crime. The crimes, committed on Sept. 5, 2005, appear quite similar to those Underwood and Mathis are accused of committing on Sept. 30.

According to the indictment, on Sept. 5, Underwood, Mathis and Allen entered the home of Eleodoro Cruz at the Whiddon Mill mobile home park and assaulted Cruz with a handgun and took money from him. They also took a wallet and money belonging to Alfredo Sanchez.

On July 20, 2006, Underwood, Mathis and Allen waived formal arraignment and entered a not guilty plea.

In case 2005CR312, Underwood, Mathis and Allen are being tried for armed robbery, aggravated assault, burglary and possession of a firearm during the commission of a crime. The crimes were committed on Sept., 14, 2005.

According to the indictment, Underwood, Mathis and Allen are charged with entering the home of Ascencron Arzade on Berry Lane, hitting Arzade with a handgun and taking money, a cell phone and “a financial transaction card” from him.

Underwood, Mathis and Allen entered a not guilty plea on July 20, 2006.

In case 2005CR313, Stacey Bernard Sims, co-defendant with Underwood and Mathis in the murders occurring on Sept. 30, 2005, will be tried with them for crimes the three men are alleged to have committed on Sept. 28, 2005. They are being tried for three counts of armed robbery, three counts of aggravated assault, two counts of burglary and two counts of possession of a firearm during the commission of a crime.

According to the indictment, on Sept. 28, 2005 — two days before the six Hispanic men were murdered — Underwood, Mathis and Sims allegedly entered the home of Tereso Rodriquez on Bill Bowen Road and hit him, Juan Rodriquez and Miguel Angel Rodriquez with a baseball bat and threatened them with a gun. They allegedly took a ring and wallet with money from Juan Rodriquez.

On the same date, Underwood, Mathis and Sims, are alleged to have entered the home of Jose Juan Garcia on Cemetery Road in Omega and took a cellphone and wallet with money from Garcia and money from Juvencio Obregon after threatening them with a handgun.

On July 20, 2006, the three men waived formal arraignment and entered not guilty pleas.

Other cases on the criminal court calendar include:

Roderick Antwon Cole, 26, indicted by the grand jury on May 30, 2006, for kidnapping, false imprisonment, rape, aggravated assault and burglary for crimes committed in February 2006. The alleged victim was Cole’s ex-girlfriend. According to the indictment, Cole abducted the victim against her will and dragged her into a residence where he locked the door and refused to let her leave. He allegedly raped and assaulted her with a razor held against her throat and threatened to cut her. Cole entered a not guilty plea on June 23, 2006. The victim filed a Family Violence 12 Month Protection Order against Cole in March 2006.

Roy Daylon Thomas of Fitzgerald was indicted by the grand jury on Aug. 31, 2006, for four counts of robbery by force and criminal attempt to commit robbery by force for crimes committed on June 29, 2006. Thomas is alleged to have robbed Flash Foods on Seventh Street, the Dixie Station on Highway 41 North, and the Quality Inn on King Road. According to the indictment, he took money from Robert Brink, who he shoved to the floor, and then took money from the cash register, demanded money from Chadrene Nelson, took money from Dara Baptiste, grabbed Keisha Walker by the arm and demanded money, and put Levenia Harnage on the floor and took money from the cash register. Thomas entered a not guilty plea on Sept. 22, 2006.

Augustus Brown, 27, is charged with aggravated assault, possession of a firearm during the commission of a crime and possession of a firearm by a convicted felon. The charges stem from an incident in July 2006, when Brown is alleged to have shot 41-year-old Deborah Golden in the front yard of her residence on Brookvale Drive.

Taurus Lorenza Young, 22, and Donnell Jermaine Davis, 29, were indicted by the grand jury on May, 30, 2006, for rape, burglary and theft by taking for crimes committed on May 19, 2006. According to the indictment, Davis aided and abetted Young in commission of the crimes. Young and Davis allegedly stole a 2001 Nissan Sentra after the rape and burglary. Young and Davis allegedly fled out of state and were extradited from Virginia to face charges. They entered a not guilty plea on June 23, 2006.

Eric Lavette Jackson was indicted by the grand jury on May 30, 2006, for kidnapping, false imprisonment, inticing a child for indecent purposes, aggravated sexual battery, child molestation, aggravated sodomy, aggravated child molestation and rape for incidents occurring on Dec. 25 and 26, 2003, with an 8-year-old female child. Jackson entered a not guilty plea on June 23, 2006.

Earnest Alexander Branner and Kensley Matrael Collins, were indicted by the grand jury on May 30, 2006, for murder. According to the indictment, on May 7, 2006, acting together, they shot Napoleon Todd Brooks, 17, in the head with a handgun. Brooks died several days after being shot in the temple. Branner and Collins entered a not guilty plea on June 23, 2006.

Xavier Antwon Bryant was indicted by the grand jury on May 30, 2006, for aggravated sexual battery, aggravated child molestation, child molestation and aggravated sodomy for crimes committed between Dec. 31, 2004 and June 2, 2005, with a 10-year-old female child. Bryant entered a not guilty plea on June 23, 2006.

Justin Troup was indicted by the grand jury on Aug. 31, 2006, for aggravated assault and cruelty to a child in the first degree for crimes committed on July 27, 2006, against a male juvenile. According to the indictment, the 13-year-old boy was assaulted and a knife was held to his throat. Troup entered a not guilty plea on Sept. 22, 2006.

Brian Blackmon was indicted by the grand jury on Oct. 30, 2006, for child molestation and statutory rape for crimes committed on four separate occasions between Aug. 1 and Sept. 14, 2006, with a 14-year-old female.

Claude Burroughs, 44, was indicted by the grand jury on Aug. 31, 2006, for aggravated battery and aggravated assault for crimes committed on March 10, 2006. According to the indictment, Burroughs caused bodily harm to Henry Burks by striking him in the face, fracturing his facial bones and causing disfigurement. Burroughs entered a not guilty plea on Sept. 19, 2006. Burroughs is also facing an indictment for the sale of cocaine stemming from a Tifton drug sweep in March 2006, in which 62 individual warrants were issued.

Homero Carlos Lopez, Eliazar Robles and Fernando Salazar were indicted by the grand jury on Oct. 31, 2005, for trafficking in cocaine, possession of a firearm during the commission of a felony and theft by receiving stolen property for crimes committed on July 17, 2005. The three men were arrested after a traffic stop on Brighton Road. Officers allegedly recovered a gallon-size zipper bag containing cocaine, a white plastic trash bag with $12,971 wrapped with rubber bands, an additional $1,116, a Ruger 9 mm handgun and a .357 caliber Smith and Wesson revolver. The Smith and Wesson revolver was allegedly stolen. Lopez, Robles and Salazar entered a not guilty plea on Dec. 13, 2005.

Ernest Lee Jackson was indicted by the grand jury on March 13, 2006, for rape and criminal attempt to commit aggravated sodomy for crimes committed on Jan. 31, 2004. Jackson entered a not guilty plea on April 6, 2006.

Jeremy Dewayne Williams was indicted by the grand jury on March 13, 2006, for aggravated sexual battery, child molestation and criminal attempt to commit aggravated child molestation for crimes committed on Oct. 24, 2005, with a four-year-old female. Williams entered a not guilty plea on June 28, 2006.

Steven Earl Kubasto was indicted by the grand jury on March 13, 2006, for rape, aggravated child molestation and child molestation for crimes committed between July 9, 2002, and Oct. 31, 2005, with a female child and a male child.
