104 criminal cases scheduled

A man accused of being a hungry burglar, who is demanding a speedy trial, and a woman accused of arson who allegedly set fire to a Tifton apartment four years ago are two of the 104 cases to be called for hearings on motions in their criminal cases on Wednesday, August 1.
According to the order issued by Chief Judge Gary McCorvey, all motions in these 104 cases will be heard on that date. His order stated that any defendant who wished to plead guilty through a negotiated plea agreement should do so on that date. McCorvey said in the order that August 22 would be reserved in the event there was not enough time to take the guilty pleas. His order said any defendant who did not reach a plea agreement and enter a guilty plea was scheduled to appear for trial on Aug. 27.
Michael Reed, who is currently a resident of Coastal State Prison in Garden City, was indicted by a Tift County grand jury on Oct. 31, 2005, for burglary, theft by receiving stolen property and four counts of financial identity fraud. According to the indictment, on March 2, 2005, Reed is charged with entering the home of Lynell Kirkland and taking a black onyx ring, a gold bracelet and five pairs of gold earrings along with “property of Royal Pharmacy.” On that same date he is alleged to have used Kirkland’s Citibank Mastercard to purchase goods from Royal Pharmacy. Then, on March 28, 2005, without permission from Kim Rutland, he allegedly used her Capitol One Visa card to purchase goods at Harvey’s supermarket, Winn Dixie, and Western Sizzlin.
Reed entered a not guilty plea at his arraignment in December 2005. He was released on bond by Judge Larry Mims on Jan.17, 2006.
On Jan. 24, 2006, he commited the crime of fraudulent credit card in Crisp County and was sentenced to three years. He was also sentenced to five years for burglary in Crisp County. He began serving his Crisp County sentence in September 2006 and becomes eligible for parole in February 2009. His prior convictions include theft of a credit card in DeKalb County where he was sentenced to two years on that conviction.
In a letter to the Tift County court dated June 25, 2007, Reed filed a motion, pro se, for a “fast and speedy trial” and said that he had been prejudiced by the long delay in bringing his case to trial. He told the court that because there is a detainer on him he has been held at a higher security level at the Coastal State facility and cannot participate in the prison’s programs, such as work release.
Sylvia Thea Wallace, aka Sylvia Jones, was indicted on two counts of first-degree arson by a Tift County grand Jury on Jan. 13, 2004. The indictment stated that on Sept. 27, 2003, Wallace set fire to the apartment of Willie Mims Jr., located at 109 E. 13th St. Wallace’s defense attorney, Sheri Smith, filed a plea of mental incompetence to stand trial in June 2005. Smith stated in the plea that after Wallace was examined by a qualified psychiatrist it was determined that she was incapable of understanding the nature of the charges against her.
On bond, Wallace had been residing at the House of Health and Hope in Adel and is now residing at an apartment in Valdosta.
Ricky Day with the Tifton Police Deptartment is scheduled to be the state witness against Wallace.
